ViralKaya ("ViralKaya", "we", "us") is an AI-powered content generation tool that helps affiliates and content creators produce scripts and captions for platforms such as TikTok, Threads and Facebook.

By creating an account, subscribing, purchasing credits, or otherwise using ViralKaya, you agree to these Terms & Conditions. If you do not agree, please stop using the service.

• You must provide a valid email address and verify it before using the app.
• Accounts are for one person. Sharing login credentials is not allowed.
• You are responsible for all activity under your account, including keeping your password secure.
• You must be legally able to enter into a contract in your country of residence.

• ViralKaya Pro is a recurring monthly subscription charged through our third-party payment processor. We do not store your card details.
• Your subscription renews automatically each month until you cancel it. You may cancel at any time from the billing portal inside the app.
• Pro includes a monthly allowance of content generations. The allowance resets each billing month and unused generations do not carry over.
• Current pricing may be promotional. If you cancel and later subscribe again, the price available at that time may be higher. We do not guarantee that any previous or promotional price will remain available.
• We may change prices, plan limits or features. Changes to an existing subscription price will be communicated before they take effect.

• Credit top-ups are an optional add-on for users with an active Pro subscription.
• Purchased credits do not expire.
• An active Pro subscription is required to spend credits. If your subscription lapses, your remaining credits stay in your account but cannot be used until you resubscribe.
• Credits are non-transferable, cannot be exchanged for cash, and have no monetary value.

All payments made to ViralKaya are final and non-refundable.

This includes, without limitation:

• Subscription fees, including for partial or unused billing periods;
• Credit top-up purchases, whether the credits are used or unused;
• Unused monthly content generations;
• Accidental, duplicate or mistaken purchases;
• Dissatisfaction with AI-generated output, or the performance of content you published (views, engagement, clicks, sales or commissions);
• Accounts suspended or terminated for breaching these Terms.

Cancelling your subscription stops future billing only. You keep access until the end of the period you already paid for; no partial or pro-rated refund is issued for that period. Please review the plan and pricing carefully before purchasing.

• Do not use ViralKaya to create or distribute content that is illegal, hateful, harassing, defamatory, sexually explicit, or harmful to minors.
• Do not use the service for scams, misleading health or financial claims, or content that breaches the rules of the platform you publish on.
• Do not resell, sublicense, scrape, reverse engineer or automate access to the service without our written permission.
• Community rules: posts are reviewed before they become publicly visible. Profanity, lewd content, phone numbers, personal contact details and spam are not allowed. We may hide or remove any post or reply.

• Output is generated by AI models and may contain inaccurate, outdated or misleading statements. Always review and edit before publishing.
• You are solely responsible for the content you publish and for complying with the rules of TikTok, Threads, Facebook and any affiliate programme you take part in (for example Shopee Affiliate), including disclosure requirements.
• We do not guarantee any particular result, reach, engagement, income or commission from using generated content.
• You may use the generated content for your own commercial purposes. Similar output may be generated for other users; we do not grant exclusivity over any phrase or idea.

When you paste a product link, we fetch publicly available information from that page to help generate content. That information may be incomplete, outdated or incorrect, and may change without notice.

ViralKaya is an independent tool and is not affiliated with, endorsed by, or sponsored by Shopee, Lazada, TikTok, Meta or any other platform mentioned in the app.

The service is provided "as is" and "as available". We may add, change, limit or discontinue features, and there may be downtime for maintenance, third-party outages or issues beyond our control. We do not guarantee uninterrupted or error-free operation.

We may suspend or terminate your account, without refund, if you breach these Terms, abuse the service, attempt to bypass usage limits or payment, or engage in fraudulent or unlawful activity. You may stop using ViralKaya and delete your account at any time.

To the maximum extent permitted by law, ViralKaya is not liable for any indirect or consequential loss, including lost income, lost affiliate commissions, lost data, account restrictions or bans imposed by third-party platforms, or reputational harm arising from your use of the service or of generated content.

Our total liability for any claim relating to the service is limited to the amount you paid to us in the one (1) month immediately before the event giving rise to the claim.

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continuing to use ViralKaya after an update means you accept the revised Terms.

These Terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over any dispute, without affecting any statutory consumer rights you may have where you live.
